Apostille for India.

Florida documents, accepted in India.

India accepts Hague apostilles, and the requests we see most for India involve OCI applications, marriage registration, and employment. Whatever the process on the receiving end, the Florida side is the same: the document must carry a Florida apostille from the Department of State in Tallahassee — which is exactly what we file, in person, every business day.

Two rules save India-bound customers the most time. First: the apostille certifies the Florida document — India's authorities may separately require a certified translation, which is done after the apostille so the certificate itself is translated too. Second: vital records must be certified originals (state Bureau of Vital Statistics or county Clerk), never photocopies.

From anywhere in the U.S.: order online, we review your documents, then FedEx emails you a pre-paid QR code, and your document is filed at the state counter and returned apostilled in 5–7 business days — $220 per document, state fee and shipping included. In South Florida or Tampa Bay, meet us in person by appointment instead.

Where Florida documents go in India

For India, most orders are for one of three things. An OCI (Overseas Citizen of India) application, a power of attorney for property or a bank account in India, or a personal record such as a birth, marriage or divorce document that an Indian office or court needs to see.

India has been a party to the Apostille Convention since 14 July 2005 (HCCH status table). India's Ministry of External Affairs says a document apostilled by a member country needs "no further attestation or legalization" and is treated as legalized "for all purposes in India" (MEA: Attestation/Apostille). The Consulate General of India in Atlanta, which serves Florida, tells applicants that U.S. documents should be apostilled by the Secretary of State of the state concerned, and that after that "no certification by the Consulate is required." For a Florida document, that means the Florida Department of State, where we file every order in person.

One mix-up we see often: India's own apostille authority, the MEA, only apostilles documents issued in India. It can't apostille a Florida certificate.

Florida documents for an OCI application to India

The official OCI FAQ says a birth or marriage certificate issued in a Hague Convention country is accepted with an apostille, "without any further attestation." Here's what that means for Florida families:

  • Applying through a parent or grandparent. The birth certificates that connect you to the Indian-origin relative are your proof of relationship. Any of them issued in Florida needs a Florida apostille.
  • Spouse of an Indian citizen or OCI cardholder. You need a registered marriage that has lasted for a continuous period of at least two years before you apply. To be apostilled, a Florida marriage certificate must be signed by the State Registrar or a Clerk of the County Court.
  • No translation. The OCI FAQ asks for an authorized English translation only when a certificate is in another language. Florida certificates are in English.

The Florida-side trap: we don't accept vital records certified before 2014, because the signature on file must be the current State Registrar's. Before you start the OCI paperwork, order fresh certified copies through VitalChek or the Bureau of Vital Statistics. Two birth certificates and a marriage certificate are three documents, so they cost $160 each, or $480 in total.

Powers of attorney for property and banks in India

If you live in the U.S. and someone in India needs to sell, buy, register or manage property for you, or deal with your bank, you'll sign a power of attorney here. This is the usual path:

  1. Get the wording from India

Ask your lawyer in India for the exact text. Many templates have lines for two witnesses, so ask how they want those filled in before you sign.

  2. Sign before a Florida notary

The notarial certificate must be complete and in English, with the notary's original signature and seal. You can also sign over video through our online notarization from anywhere in the U.S. or abroad: $40 for the first document ($10 notarization fee + $30 technology platform fee).

  3. We apostille it in Tallahassee

We file it in person at the Florida Department of State and return it in 5–7 business days. It's $220 for one document, and international return shipping to India adds $100 per order.

  4. Stamp it in India on time

Section 18 of the Indian Stamp Act lets an instrument signed outside India be stamped within three months after it is first received in India. States set their own stamp rules and rates, so your lawyer will tell you what applies.

Before you order a Florida apostille for India

A few minutes of checking now saves a second round trip to Tallahassee.

  • Find out who receives the document (OCI application, sub-registrar, bank or court) and whether they want the original or copies.
  • Vital records must be certified in 2014 or later and signed by the current State Registrar. Order a fresh copy from VitalChek if yours is older.
  • Divorce decree: certified by the Clerk of Court with a wet-ink certification or the clerk's official e-certification. A plain copy won't work.
  • Power of attorney: use the wording from India, arrange any witnesses, and make sure the Florida notarial certificate is complete and in English.
  • Diploma or transcript for a job or admission in India: it must be notarized when the school issues it, with the registrar signing in front of a notary.
  • After it arrives in India, the three-month stamping window for a power of attorney starts. Send it with time to spare.

Common questions.

Yes — India is a Hague Apostille Convention member. A Florida apostille from the Department of State is accepted without embassy legalization.
The apostille itself is a standardized multilingual certificate. Whether the underlying document needs a certified translation depends on the receiving authority in India — when required, translate after apostilling so the certificate is covered too.
We apostille Florida-issued and Florida-notarized documents. A document from another state needs that state's apostille — but any document can be notarized by a Florida notary (including online) and then apostilled here.
$220 per document all-in — state fee, application, and FedEx both ways within the U.S. included. 5–7 business days door to door. Bundles: $380 for two documents, $160 each for three or more.
