Florida divorce records for foreign use.

Floridians apostille divorce decrees most often for foreign remarriage (most countries require proof of a finalized prior divorce before issuing a new marriage license), foreign citizenship applications (especially Italian jure sanguinis cases where divorce records affect the line of descent or name history), international child custody and support cases (where Florida divorce orders need to be recognized or enforced abroad), and foreign property division (where assets located abroad were addressed in the Florida divorce judgment).

A Florida divorce decree is a court record. The Clerk of Court in the county where the divorce was granted certifies a copy of the final judgment of dissolution of marriage, and the Department of State apostilles the clerk's certification ($20 state fee). We accept a paper copy with the clerk's original stamp, seal and signature, or the clerk's official e-certification. The copy handed to you at the final hearing, a copy from your attorney's file, a free online image or a notarized photocopy can't be apostilled.

Some offices accept the one-page dissolution of marriage certificate instead — a vital record from the Bureau of Vital Statistics, $10 state fee when signed by the State Registrar. Most foreign courts and civil registries want the full judgment, so ask before you order. Remarrying abroad usually takes the decree plus the earlier marriage certificate: $380 for both. How to order a certified divorce decree →

Florida divorce decree apostille, step by step.

1. Find the right county and case number. Certified copies come from the clerk of the county where the divorce was granted. Florida restricts online access to family records, so you may need to register with the clerk's portal — or call the records office with both names and the approximate year.

2. Decide which pages you need. The final judgment often attaches a marital settlement agreement or parenting plan. A foreign court dealing with custody or property will want them; a marriage registry may want only the judgment. Request everything you need as one certified copy.

3. Order it. Most clerks take orders online, in person and by mail, at mostly statutory fees — Miami-Dade, for example, lists $1 per page plus $2 per certification by mail. If you're a party and the online copy is redacted, ask for the unredacted version.

4. Leave it as issued and send it to us. Don't unstaple it, add pages or write on it. We file it in person and return it in 5–7 business days. A divorce granted in another state is apostilled by that state.

When you need an apostilled divorce decree.

These are the most common reasons Floridians apostille their divorce decrees.

Foreign Remarriage

Marrying again in another country? Most foreign governments require an apostilled prior divorce decree before issuing a new marriage license. Italy, Spain, Portugal, Mexico, and the Caribbean — all standard.

Foreign Citizenship Applications

Italian, Polish, and other ancestral citizenship applications sometimes require apostilled divorce decrees in the line of descent — particularly where ancestor relationships, name changes, or remarriages affect the application.

International Custody & Support

Florida divorce judgments that include child custody, child support, or visitation orders need to be apostilled when seeking foreign enforcement or recognition of those orders under the Hague Convention on parental responsibility.

Foreign Property Division

When the Florida divorce judgment addressed property located abroad (real estate, bank accounts, business interests), the apostilled judgment is required to enforce or record that division in the foreign jurisdiction.

Name Restoration Abroad

Restoring your maiden name on foreign government records, banks, or property registries after divorce usually requires an apostilled divorce decree as proof of the name change.

Foreign Inheritance Matters

Foreign probate proceedings sometimes require apostilled divorce decrees to clarify marital status at the time of an inheritance event or to establish heirs' eligibility.

Common questions.

From the Clerk of Court in the county where the divorce was granted — online, in person or by mail, at mostly statutory fees (a few dollars per document). Ask for a certified copy of the final judgment for an apostille; a paper copy with the clerk's original certification or the clerk's official e-certification both work. Step-by-step ordering guide →
The final judgment of dissolution of marriage is the court's order, certified by the Clerk of Court. The dissolution of marriage certificate is a one-page vital record from the Bureau of Vital Statistics that only summarizes it. Both can be apostilled, but most foreign courts, consulates and registries expect the clerk-certified final judgment.
No — we only apostille Florida-issued documents. If your divorce was finalized in another state, you'll need to use that state's apostille service. The decree must be authenticated by the state that issued it.
It depends on what's sealed. If the entire judgment is under seal, you'll need to petition the court to unseal it before apostille is possible. If only certain exhibits or attachments are sealed, the main judgment can usually still be apostilled. Talk to your Florida attorney first.
Often, yes. Foreign remarriage applications usually want both: the prior marriage certificate (showing the marriage existed) and the divorce decree (showing it ended). Italian citizenship applications sometimes also request both. Bundle pricing: $380 for 2 documents.
